Website Management Terms & Conditions

Welcome to Fortitude S&O LLC. By using our services, you agree to the following terms and conditions. Please read them carefully.

1. Overview of Services

Fortitude S&O LLC provides website creation and management services under a subscription-based contract. To qualify for a free website, the client must sign up for a minimum one-year website management subscription. Billing will not begin until the website is launched, but contracts must be signed before work begins.

2. Subscription Pricing & Terms

Clients agree to a subscription-based website management plan with the following pricing structure:

  • 1-Year Plan: $400 per month

  • 2-Year Plan: $350 per month

  • 3-Year Plan: $250 per month

  • 4-Year Plan: $150 per month

Plan Adjustment Policy:

  • Clients may change their pricing tier by signing a new contract, which will take effect from the new contract date.

  • Minimum subscription commitment is one-year increments.

3. Contract Terms

  • Unless notified in writing at least 30 days before the contract's end date, the contract will automatically renew for the same term length at the current pricing.

  • Clients must sign a contract before work begins.

  • Clients may cancel within 14 days of signing the contract without penalty.

  • If cancellation occurs after 14 days, clients must either:

    • Pay out the full remaining term of the agreement, OR

    • Continue paying monthly until the contract is fully paid.

  • This policy ensures Fortitude S&O LLC recoups the cost of website development.

  • Clients must sign a contract before work begins.

  • Clients may cancel within 14 days of signing the contract without penalty.

  • If cancellation occurs after 14 days, clients must either:

    • Pay out the full remaining term of the agreement, OR

    • Continue paying monthly until the contract is fully paid.

  • This policy ensures Fortitude S&O LLC recoups the cost of website development.

4. Payment & Billing

  • Payments will be auto-billed monthly through [Stripe, PayPal, ACH, etc.].

  • Payments are due on the 1st of each month.

  • Late payments exceeding 15 days may result in website suspension until payment is received.

  • All clients are required to enroll in autopay.

5. Client Responsibilities

Clients must:

  • Provide all necessary content (text, images, logos) in a timely manner.

  • Approve website drafts and revisions within five business days.

  • Provide accurate business details for website setup.

  • Pay all third-party costs (e.g., premium plugins, additional hosting features).

  • Maintain and renew their domain if not purchased through Fortitude S&O LLC.

6. Ownership & Data Rights

  • The website remains under Fortitude S&O LLC’s management during the contract term.

  • Clients may request full website ownership upon contract completion.

  • Clients may purchase their domain & website upon termination, with pricing to be determined.

  • Fortitude S&O LLC retains the right to use design elements for promotional purposes.

7. Termination & Suspension

  • Fortitude S&O LLC reserves the right to terminate the contract for any reason with a 30-day notice provided to the client.

  • Fortitude S&O LLC will not be responsible for any loss of profit, customers, or other damages resulting from contract termination.

  • Fortitude S&O LLC reserves the right to suspend services for unpaid invoices exceeding 15 days.

  • We may terminate services immediately if the client engages in illegal, fraudulent, or unethical activities through their website.

7.1 Non-Engagement & Non-Disparagement Policy

  • Clients and employees may not engage with each other in any business-related matters outside of the contractual relationship for the duration of the contract.

  • This restriction applies for at least 32 months after the contract or employment ends.

  • Any exceptions must be authorized by Fortitude S&O LLC through a signed waiver, explicitly stating the approved contact and engagement terms.

  • Clients and employees are prohibited from making any disparaging or defamatory statements about Fortitude S&O LLC, its services, employees, or affiliates during the contract period and for 32 months after contract termination or employment ends.

  • Any content created by clients or employees that relates to Fortitude S&O LLC’s services, branding, or business operations must be pre-approved by Fortitude S&O LLC before being posted, published, or shared in any format.

  • Clients and employees may not engage with each other in any business-related matters outside of the contractual relationship for the duration of the contract.

  • This restriction applies for at least 32 months after the contract or employment ends.

  • Any exceptions must be authorized by Fortitude S&O LLC through a signed waiver, explicitly stating the approved contact and engagement terms.

  • Fortitude S&O LLC reserves the right to suspend services for unpaid invoices exceeding 15 days.

  • We may terminate services immediately if the client engages in illegal, fraudulent, or unethical activities through their website.

8. Limitation of Liability

Fortitude S&O LLC is not liable for:

  • Third-party hosting downtime or technical failures.

  • Security breaches resulting from weak client passwords or hacking attempts.

  • Legal claims regarding website content (e.g., copyright infringement claims).

9. Support & Maintenance Hours

  • Our support team operates Monday – Friday (24 hours).

  • Support on Saturday & Sunday is available for $125 per hour.
